ALBEPRO General and Shipping Terms – version 2026.1

Article 1. Definitions and Applicability
1.1 ALBEPRO refers to Albepro.nl, located in Helmond, Netherlands.
1.2 These terms and conditions apply to all offers, orders, agreements, and deliveries from ALBEPRO.
1.3 By placing an order, the customer agrees to these terms and conditions.
1.4 Customer’s general terms are explicitly rejected unless agreed in writing.
1.5 If any provision is invalid, the remaining provisions remain fully in force.
Article 2. Offers and Agreements
2.1 All offers are non-binding unless stated otherwise.
2.2 An agreement is formed when ALBEPRO confirms the order in writing or executes it.
2.3 ALBEPRO reserves the right to refuse orders or set additional conditions.
2.4 Obvious errors or typos in prices or product information are not binding.
Article 3. Prices
3.1 All webshop prices are in Euro and include 21% Dutch VAT, unless stated otherwise.
3.2 Shipping costs are calculated automatically during checkout.
3.3 Price changes after the agreement are only possible due to legal requirements or force majeure.
Article 4. Payment
4.1 Payment can be made via ALBEPRO’s accepted methods: iDEAL, PayPal, Bancontact, Sofort, Visa, Mastercard, Maestro, or bank transfer.
4.2 Certain payment methods may incur transaction fees.
4.3 The customer must pay the full invoice amount.
4.4 Payment not received within 10 days of invoice date results in default.
4.5 ALBEPRO may charge statutory interest and collection costs in case of default.
4.6 If a payment is disputed via PayPal, credit card, or other service (chargeback), ALBEPRO may provide all relevant information to the payment provider.
4.7 If a payment is unjustly disputed, the payment obligation remains fully in effect.
Article 5. Delivery and Shipping Terms
5.1 Orders are shipped within 3 business days after full payment, provided products are in stock.
5.2 Delivery occurs to the address provided by the customer.
5.3 Consumers (B2C): risk of loss or damage passes when the customer or a designated third party physically receives the package.
5.4 Business customers (B2B): risk passes when the package is handed over to the carrier.
5.5 Customers are responsible for providing the correct address. Changes after shipment are not possible; all risks remain with the customer.
5.6 Packages not collected from pickup points or returned to ALBEPRO: return and re-shipping costs are fully the customer’s responsibility.
5.7 Using forwarding addresses, third-party addresses, or PICP services is at the customer’s own risk. Delivery to these addresses is considered legally valid.
5.8 Belgium: first delivery attempt is at the provided address; if recipient is absent, package goes to the nearest pickup point; no second delivery attempt.
5.9 Orders of €100 or more are shipped free within the Netherlands and Belgium. Other destinations: shipping costs calculated automatically.
5.10 Customs, import duties, or taxes for international shipments are fully the customer’s responsibility.
5.11 The customer must inspect the delivery immediately. Any visible damage or missing items must be reported to ALBEPRO within 48 hours.
5.12 Carrier tracking or delivery confirmation serves as proof of shipment and delivery.
Article 6. Warranty and Liability
6.1 Only manufacturer warranty applies.
6.2 ALBEPRO is not liable for damage caused by incorrect use of products.
6.3 Liability is limited to the invoice value of the order, except in cases of intent or gross negligence.
6.4 ALBEPRO is not liable for indirect damages, consequential loss, or lost profits caused by third parties, including carriers.
Article 7. International B2B Orders and EU VAT
7.1 All webshop orders are invoiced including 21% Dutch VAT.
7.2 EU businesses with a valid VAT number may only qualify for intra-community supply after prior approval by ALBEPRO.
7.3 Orders placed via the webshop cannot be converted to intra-community delivery afterwards.
7.4 Conditions for intra-community delivery:

minimum order value €200 excluding shipping

VAT number verification via the VIES system

payment in advance by bank transfer
7.5 Customers may not deduct VAT themselves.
7.6 If payment does not match the invoice, ALBEPRO may cancel the order.
Article 8. Right to Refuse Orders
8.1 ALBEPRO reserves the right to refuse or cancel orders without giving reasons.
8.2 Received payments will be fully refunded.
8.3 This applies to customers who have previously initiated a payment dispute or fraud.
Article 9. Force Majeure
9.1 ALBEPRO is not liable for delays or non-performance due to force majeure.
9.2 Force majeure includes, but is not limited to: supplier failures, transport issues, strikes, or technical problems.
9.3 If force majeure lasts more than two weeks, ALBEPRO may terminate the agreement.
Article 10. Retention of Title
10.1 Products remain property of ALBEPRO until full payment.
10.2 Pledging or encumbering by the customer is not allowed.
Article 11. Intellectual Property
11.1 All intellectual property rights of products, images, and texts remain with ALBEPRO or its suppliers.
Article 12. Privacy and Cookies
12.1 Personal data is processed according to applicable privacy laws.
12.2 Data is used for order processing, communication, and webshop analysis.
12.3 Cookies are used for navigation, shopping cart, and analytics.
Article 13. Applicable Law and Disputes
13.1 Dutch law applies to all agreements.
13.2 The Vienna Sales Convention is expressly excluded.
13.3 Complaints can be sent to info@albepro.nl; ALBEPRO strives to respond within 7 days.
Article 14. Intellectual Property
14.1 All texts, images, product descriptions, logos, and other content on this website are the exclusive property of Albepro.
14.2 You may not copy, reproduce, publish, distribute, or otherwise use any of this content without the prior written consent of Albepro.
14.3 Any unauthorized use of this content may result in civil and/or criminal legal action.
